Let’s Get You Ready to Play!

This Agreement is entered into between: VirtoKids, LLC ("VirtoKids"), located at 11 Camelia Way, Southern Pines, NC 28387, and the undersigned Parent/Guardian. Effective Date: The date signed below. 1. Program Overview & Eligibility VirtoKids provides supervised play and enrichment experiences for children aged 2.5 to 10 years old. This is not a licensed childcare facility, but a recreational, community-based space designed to encourage play, creativity, and social interaction. Parents/guardians acknowledge and agree: VirtoKids operates as both a drop-off play space and a family-inclusive Stay & Play experience, depending on the booked session. During Stay & Play, parents/guardians remain responsible for supervising their children at all times while on-site. VirtoKids staff may offer general support, but the parent/guardian maintains primary responsibility. During Drop-Off Play sessions, VirtoKids staff provide general supervision and oversight of participating children for the scheduled session. For on-site and off-site events (such as pop-ups, community programs, or collaborations), children must remain under the supervision of VirtoKids staff or the attending parent, as specified per event. Children attending birthday parties or private events are under the supervision of either the event host, attending parent, or VirtoKids staff, depending on the structure of the event. Children must be fully potty trained. If there is any concern, a diaper or pull-up is required. VirtoKids/Sandhills Nanny Co. staff are authorized to provide guidance, redirection, and general assistance to help maintain a safe environment. 2. Assumption of Risk & Waiver of Liability Physical play and interaction with peers involve inherent risks, including slips, trips, falls, allergic reactions, behavioral challenges, and injuries. By signing this Agreement, parents/guardians voluntarily assume all such risks on behalf of the participating minor and fully release and discharge VirtoKids, its owners, officers, employees, agents, contractors, and volunteers from any and all claims, damages, or causes of action arising out of or related to participation in any VirtoKids program, stay & play session, drop-off childcare, or event—whether on-site or off-site—unless caused by gross negligence or willful misconduct of VirtoKids. 3. Health & Safety Agreement Parents/Guardians confirm the following: - Child is in good health and free from any communicable illnesses. - Child will not attend if showing signs of illness (fever, cough, vomiting, etc.). - Children must wear non-slip (grippy) socks while in the play space unless otherwise noted for a specific event. - Any allergies, medical needs, or emergency concerns have been disclosed in writing at the time of booking. 4. Emergency Care Authorization In the event of injury or illness, the parents/guardians authorize VirtoKids staff to administer basic first aid and contact emergency services if necessary. If parents/guardians cannot be reached, and no emergency contacts are available, VirtoKids is authorized to obtain appropriate medical treatment. Any costs incurred shall be the responsibility of the parents/guardians. 5. Behavior, Timeliness & Emergency Contact - Parents/guardians must arrive on time for both drop-off and pick-up. - Parents/guardians shall remain within 15 minutes of the facility and reachable by phone/text during drop-off sessions. - For Stay & Play, parents/guardians must supervise their children directly and ensure respectful use of the facility and equipment. - VirtoKids reserves the right to dismiss any participant whose behavior presents a health or safety risk. 6. Late Pickup & No-Show Policy A $16 late fee per child will be assessed for pickups more than 10 minutes past session end time. If the child is not picked up within 15 minutes, staff will begin contacting emergency contacts. After 30 minutes with no contact, VirtoKids reserves the right to notify local authorities, including Southern Pines Police or Child Protective Services, and file a report for child abandonment. 7. Refund, Rescheduling, and Membership Cancellation All sales are final. Hourly play sessions may be rescheduled up to 24 hours before your booking begins. After that time, the session is considered paid and is non-refundable. Memberships are month-to-month and can be canceled anytime by phone, text, or email to info@virtokids.com. If cancellation occurs after the billing date, the current month’s charge is non-refundable, but future charges will be stopped. 8. Photography Consent I grant permission for VirtoKids to take and use photos or video of my child for promotional purposes in print, digital, or social media marketing. 9. Food & Drink Policy No food is allowed inside the facility due to allergy concerns. Water is permitted only in a labeled cup or bottle with a secure lid. 10. Accident & Cleaning Fee If a child has a toileting accident or causes a spill that requires deep sanitation, the parents/guardians agree to pay a $150 cleaning and sanitation fee, invoiced immediately after the incident. 11. Booking Options & Member Benefits Book online at virtokids.com/book, call, or walk in (subject to availability). 12. Party & Event Terms By booking or attending a party or event at VirtoKids, you agree to the following: Outside Vendors & Services: Some packages may include goods/services provided by independent vendors. VirtoKids is not liable for delays, cancellations, or quality issues related to outside vendors. Outside vendors may not be brought in without written approval. Cancellations & Rescheduling: Cancellations made 15+ days prior receive a 50% refund or may reschedule without penalty. Cancellations within 15 days are non-refundable. If VirtoKids cancels, a full refund or credit will be issued. Guest Conduct & Damages: Clients are responsible for guest behavior and any damages to the facility or equipment. VirtoKids may end an event early if unsafe or disruptive behavior occurs. Liability: VirtoKids is not responsible for injuries, accidents, illnesses, or lost/stolen property during the event, except in cases of gross negligence by VirtoKids staff. 13. Acknowledgment and Agreement By selecting “I Agree,” I confirm that I have read, understand, and agree to the terms of this Agreement. I certify that I am the legal parent/guardian of the child(ren) listed and have the authority to consent on their behalf.
